Terms of Service

Effective Date: April 30, 2026

Article 1. Purpose

These Terms govern the rights, obligations, and responsibilities between users and MOABOT, the website operated by Moggle Co., Ltd. (the “Company”), for TradingView-based indicators, algorithm software, webhook relay software (MOAHook), and related services. These Terms also apply to e-commerce transactions through PC communications, wireless services, and similar channels to the extent consistent with their nature.

Article 2. Definitions

  1. “Mall” means the virtual business place set up by the Company through information and communications facilities to provide goods or services to users, and also refers to the operator of that cyber mall.
  2. “User” means any member or non-member who accesses the Mall and receives services under these Terms.
  3. “Member” means a person registered with the Mall who may continuously use the services provided by the Mall.
  4. “Non-member” means a person who uses the Mall's services without registering as a member.
  5. “Indicator” or “algorithm” means digital content software developed by the Company and provided through external platforms such as TradingView by granting usage permission.
  6. “Webhook relay software (MOAHook)” means software that relays TradingView alert webhooks to exchange APIs to enable strategy automation.

Article 3. Posting, Explanation, and Amendment of Terms

  1. The Mall posts these Terms and business information such as company name, representative, address, phone number, email address, business registration number, e-commerce registration number, and privacy officer so users can easily review them.
  2. Before a user agrees to these Terms, the Mall provides a separate screen or pop-up so the user can understand important matters such as restrictions on withdrawal of subscription and refund conditions for digital content.
  3. The Mall may amend these Terms within the scope permitted by applicable laws, including the Korean E-Commerce Consumer Protection Act, Act on the Regulation of Terms and Conditions, Electronic Documents and Transactions Act, Electronic Financial Transactions Act, Network Act, and Framework Act on Consumers.
  4. When amending these Terms, the Mall will announce the effective date and reason together with the current Terms from 7 days before the effective date until the day before the effective date. Changes unfavorable to users will be announced at least 30 days in advance.

Article 4. Provision and Change of Services

  1. Information provision and subscription contracting for TradingView indicators such as HyperRSI DCA and Hyper Trend, and algorithm software.
  2. Granting access to contracted digital content, including invite-only script permissions.
  3. Granting access to webhook relay software (MOAHook).
  4. Other services determined by the Mall.

The service does not make investment decisions for users or recommend buying or selling specific financial products. Users directly decide and manage strategy selection, parameter input, webhook connection, API connection, and whether to execute orders.

Article 4-2. User Responsibilities

  1. Users directly decide and manage strategy selection, parameter input, webhook connection, exchange API issuance and connection, and order execution.
  2. Users bear responsibility for investment gains and losses resulting from use of the service.
  3. Users must verify applicable laws, exchange terms and policies, and third-party service conditions and use the service based on their own judgment and responsibility.

Article 4-3. No Guarantees

  1. The Company does not guarantee profit, principal preservation, loss avoidance, or any specific investment performance through the service.
  2. Indicators, algorithms, backtest results, simulations, example screens, and other information are provided for general and technical information only. Past performance or test results do not guarantee future performance.
  3. Technical guides provided by the Company, including service usage, webhook setup, and API integration instructions, are technical explanations for using the service and do not constitute individual investment judgment, solicitation, instruction, or personalized investment advice.

Article 5. Service Suspension

The Mall may temporarily suspend the service due to maintenance, replacement or failure of information and communications facilities, communication interruption, or inspection or failure of external platforms such as TradingView or exchanges. If the Mall proves absence of intent or negligence, it is not liable for damages.

Article 6. Membership Registration

Users apply for membership by entering information in the registration form determined by the Mall and indicating agreement to these Terms. The Mall registers applicants as members unless there is false information, omission, error, or similar grounds.

Article 7. Withdrawal and Loss of Qualification

Members may request withdrawal at any time, and the Mall will process withdrawal immediately. The Mall may restrict or suspend membership for false registration, non-payment, misuse of another person's information, violation of laws, or unauthorized leakage, distribution, sale, or reverse engineering of digital content.

Article 8. Purchase Application and Consent to Personal Information Use

Users apply for purchase through the Mall by selecting goods or services, entering an email address and TradingView username, confirming the Terms and restrictions on withdrawal for digital content, and selecting a payment method.

Article 9. Supply of Goods or Services

The Mall specifies supply methods such as TradingView permission grant or email delivery and the relevant supply period. The service is supplied digitally rather than through physical delivery. The Mall is not responsible for delays or disadvantages caused by a user entering an incorrect TradingView ID.

Article 10. Withdrawal of Subscription

Users may not return or withdraw subscription after digital access has been supplied in cases such as commencement of digital content provision, including TradingView indicator access approval, or exposure of software code or grant of software permission. However, withdrawal is not restricted if the Mall did not clearly notify users in advance that withdrawal is restricted.

Article 11. Personal Information Protection

The Mall collects the minimum personal information necessary to provide the service. Collected personal information is not used for purposes outside the collection purpose except as otherwise permitted by applicable laws. Details are provided in the Privacy Policy.

Article 12. Intellectual Property and Use Restrictions

Copyrights and other intellectual property rights in works created by the Mall, including algorithm logic, source code, and UI design, belong to the Mall. Users may not reproduce, transmit, publish, distribute, broadcast, reverse engineer, extract source code, share, or otherwise use such works for profit or allow third parties to use them without prior approval. Violations may result in immediate revocation of service access and civil or criminal legal action.

Article 13. Dispute Resolution

Litigation relating to e-commerce disputes between the Mall and users will be subject to the exclusive jurisdiction of the district court having jurisdiction over the user's address at the time of filing, or residence if there is no address. Korean law applies to e-commerce litigation between the Mall and users.

Article 14. Disclaimer and Limitation of Damages

The Mall is not liable for damages incurred by members when software provision is temporarily suspended or impaired due to the following causes:

  1. Natural disasters, national emergencies, DDoS attacks, hacking, communication network failures, or other force majeure events beyond the Mall's control.
  2. System failure, policy changes, or API integration errors of external platforms such as TradingView or cryptocurrency exchanges.
  3. Issues attributable to a member's computer, mobile device, or network environment.
  4. Service suspension for previously announced maintenance, replacement, or regular inspection of service facilities.

Software, indicators, and AI algorithms, including generative AI, are provided for general information and investment reference purposes. The Company does not guarantee errors caused by technical limitations, delayed or incorrect data, or biased training data, including inaccurate information, and is not liable absent intent or gross negligence.

The Mall provides software “as is” and “as available.” The Mall is not liable for loss of expected profits or investment losses caused by market volatility, slippage, execution delay, strategy selection, parameter setting, webhook integration, or order execution.

If a member misdirects virtual assets such as USDT by entering an incorrect deposit wallet address or selecting an unsupported blockchain network, the Mall has no obligation to trace or recover the asset and is not liable for any resulting damages.

If a member incurs direct damages due to the Mall's intent or gross negligence, the Mall's liability is limited to the service fees actually paid by the member to the Mall during the most recent 1 month for the claim giving rise to the damage. For free members, liability is limited to 100 USDT or less, except as otherwise required by law.

Article 15. Permanent Service Discontinuation and Termination

  1. The Mall may permanently discontinue all or part of the service if continued service becomes objectively impossible due to legal changes, government regulation, external platform policy changes, or permanent termination of API support beyond the Company's control.
  2. When permanently discontinuing the service under the preceding paragraph, the Mall will notify users of the discontinuation date and reason at least 30 days in advance through the initial screen, email, or similar means.
  3. If the service is permanently discontinued, the Mall will refund the amount corresponding to the remaining paid service period calculated daily or monthly from the discontinuation date.

Article 16. Payment of Bot Service Fees and Membership Payment Substitution

  1. Users may pay for bot service usage directly with virtual assets such as USDT or choose a membership method in which service fees are substituted through rebate amounts generated from affiliated exchanges.
  2. For membership use, rebate amounts are calculated based on settlement data and APIs provided by the Company's designated affiliated exchanges. If rebates are not normally processed due to exchange policy changes, system errors, or a user's violation of exchange terms, the Mall is not responsible and may directly charge the user for any shortfall in bot service fees.

Article 17. Membership Payback and Taxes

  1. If, during membership use, rebate amounts exceed the substituted bot service fees and are paid to the user as payback, the user is responsible for all taxes and public charges arising from receipt of such payback, including comprehensive income tax, and for reporting them.
  2. The Mall may request identity verification (KYC) and tax-related information before payback payment in accordance with applicable laws and anti-money-laundering regulations. If the user refuses or provides false information, the Mall may suspend or reject payback payment.

Supplementary Provision

These Terms take effect on April 30, 2026.
